Suppression hearing set for March 18th in Oakfield Murder Case

A hearing has been set to determine whether statements made by an Oakfield man can be used during his trial for the murder of his father. Judge Michael Mohun of Wyoming County scheduled a Huntley hearing for March 18 in Genesee County Court.

Nicholas M. Maher, 37, is charged with one count of second-degree murder for the death of his father, Martin Maher, 69, in October. Public Defender Jerry Ader has requested that any statements Maher made to police be ruled out during a trial.

The body of Martin Maher was found Oct. 17 after Genesee County sheriff’s deputies received a call from a relative asking that they check on him. 
Investigators determined that Maher was the victim of a homicide and a search began for his son, who lived with him at 32 Drake St.
The son was found four hours later in Erie County and taken into custody without incident. Maher remains in Genesee County Jail as his case continues.
