Being Held Without Bail:

5-time Nunda felon found with loaded gun on private property

By Scott Desmit - sdesmit@batavianews.com

An investigation into a complaint that a man with a gun was walking around property on Coe Road early Friday morning has led to numerous charges against a five-time felon, village police said. Wyoming County sheriff’s deputes were called to Coe Road just after 2 a.m. for a report that someone had driven onto the complainant’s property and was walking around with what appeared to be a gun.

The man drove off when confronted but was seen by a village patrol officer on Route 246 and heading into the village on North Center Street. The Dodge Ram was stopped and Russell L. Allen, 40, of Nunda was determined to be the driver. Village police and sheriff’s deputies found a loaded 12-gauge Mossberg shotgun in the truck and determined Allen had no valid driver’s license.

Allen, who has been convicted of felonies five times, is not allowed to own a gun.

He was charged with second-degree criminal possession of a loaded firearm, a class C felony punishable by up to 15 years in prison, fourth-degree criminal possession of a weapon, two counts of aggravated unlicensed operation, using a rented/leased or loan vehicle without an Interlock device and unlicensed operation.

Allen was arraigned and committed to Wyoming County Jail without bail because of his criminal history. Allen has served three state prison terms: Two for aggravated unlicensed operation and one for reckless endangerment.
