She was in 'Helpless' State:
Indictment accuses man of raping intoxicated woman at GC college

A Genesee County grand jury has filed an indictment against a Holley man, accusing him of sexually assaulting a woman who was highly intoxicated at Genesee Community College.

JUAN M. MENDEZ
Juan M. Mendez, 20, is charged with first-degree rape, third-degree rape, first-degree sexual abuse and third-degree sexual abuse. The indictment accuses Mendez of raping the woman on Sept. 4 at the college. The indictment says the woman was “incapable of consent by reason of being physically helpless.” Mendez was arrested in December after a Genesee County sheriff’s investigation revealed the woman had a “high level of intoxication,” rendering her helpless.

The grand jury filed two other indictments in Genesee County Court:

■ Eric J. Reyes Jr., no age or address available, is charged with third-degree criminal possession of stolen property and aggravated unlicensed operation. He was found driving a stolen car on the Thruway in Le Roy in September.

■ Rachelle N. Laney, 34, of Oakfield is charged with third-degree criminal possession of a controlled substance with intent to sell, fourth-degree possession, two counts of seventh-degree possession and two counts of criminal use of drug paraphernalia. Laney was found with fentanyl, methodone and hydrocodone after a traffic stop in September in Le Roy.
